Terms and Conditions
1. Scope
These General Terms and Conditions (GTC) apply to all deliveries by Manufaktur Rocca to consumers.
A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business, or profession.
2. Contractual Partner
The purchase contract is concluded with Manufaktur Rocca, Pierluigi Rocca, Ulmerstr. 51, 73262 Reichenbach (hereinafter referred to as "Seller").
3. Conclusion of Contract
The presentation of products in the online shop does not constitute a legally binding offer but an invitation to order.
By clicking the button [Order with obligation to pay], you place a binding order for the goods listed on the order page.
Your purchase contract is concluded when we accept your order by sending an order confirmation via email immediately after receiving your order.
4. Right of Withdrawal
If you are a consumer (i.e., a natural person who places the order for a purpose that is not attributable to their trade, business, or profession), you are entitled to a statutory right of withdrawal.
If you exercise your right of withdrawal as a consumer, you will bear the regular costs of returning the goods.
Further details on the right of withdrawal are outlined in the Seller's cancellation policy.
Important Notice:
Pursuant to Section 312g (2) 1 of the German Civil Code (BGB), the right of withdrawal does not apply to contracts for the supply of goods that are not prefabricated and for the production of which an individual choice or determination by the consumer is decisive, or which are clearly tailored to the personal needs of the consumer. Goods that show significant assembly, wear, or bending marks due to closure or fastening are excluded.
5. Prices and Shipping Costs
Unless otherwise stated in the product description, the prices listed are total prices. VAT is not displayed as the seller is a small business under the German VAT Act (UStG).
In addition to the stated prices, we charge shipping costs for delivery within Germany and the EU.
Shipping costs are clearly indicated on the product pages, in the shopping cart system, and on the order page.
6. Delivery
Delivery is made within Germany and various EU countries. Deliveries outside Germany and the EU are only possible upon prior request via email.
Please note that customs duties and additional costs may apply when shipping outside Germany.
Delivery times are specified on the respective product pages. Shipping fees are indicated for each item.
7. Payment
Payment can be made by credit cards (Visa, MasterCard, American Express), Klarna, PayPal, and advance bank transfer.
If you choose to pay in advance via bank transfer, we will provide you with our bank details in the order confirmation, and the goods will be shipped after payment has been received.
8. Retention of Title
The goods remain our property until full payment has been made.
9. Dispute Resolution
The European Commission has created an internet platform for the online resolution of disputes. This platform serves as a contact point for the extrajudicial resolution of disputes related to contractual obligations arising from online purchase contracts. We are neither willing nor obligated to participate in dispute resolution proceedings before a consumer arbitration board.
Cancellation Policy
Right of Withdrawal
You have the right to withdraw from this contract within fourteen days without giving any reason.
The withdrawal period is fourteen days from the day on which you or a third party named by you, who is not the carrier, have taken possession of the goods.
To exercise your right of withdrawal, you must inform us of your decision to withdraw from this contract through a clear declaration (e.g., a letter sent by post to Manufaktur Rocca, Pierluigi Rocca, Ulmerstr. 51, 73262 Reichenbach, or an email to kontakt@manufaktur-rocca.de).
If you use this option, we will promptly (e.g., by email) send you confirmation of receipt of such withdrawal.
To meet the withdrawal deadline, it is sufficient for you to send the notification concerning your exercise of the withdrawal right before the withdrawal period has expired.
Consequences of Withdrawal
If you withdraw from this contract, we shall reimburse all payments received from you, including delivery costs (except for additional costs arising from your choice of a delivery method other than the least expensive standard delivery offered by us), without undue delay and at the latest within fourteen days from the day on which we received your notification of withdrawal.
We will use the same means of payment for the reimbursement as you used for the original transaction unless expressly agreed otherwise; in no case will you be charged fees for this reimbursement.
We may withhold reimbursement until we have received the returned goods or until you have provided evidence of having returned the goods, whichever is earlier.
You must return the unused goods to us or hand them over to (insert the name and address of the person authorized to receive the goods, if applicable) without undue delay and no later than fourteen days from the day on which you notify us of the withdrawal from this contract. The deadline is met if you send the goods before the period of fourteen days has expired.
You bear the direct cost of returning the goods.
You are only liable for any diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics, and functioning of the goods.
Exclusion of the Right of Withdrawal:
The right of withdrawal does not apply under Section 312g (2) 1 BGB to contracts for the supply of goods that are not prefabricated and for whose production an individual choice or specification by the consumer is decisive, or which are clearly tailored to the consumer's personal needs.
